The Supply Chain Due Diligence Act (LkSG): New standards in corporate responsibility

Since the beginning of 2023, the German Supply Chain Act has applied to companies with more than 3,000 employees. The law sets out specific due diligence obligations to ensure that human rights and environmental standards are upheld along the entire supply chain. From 2024, the law will also apply to companies with over 1,000 employees. In addition, larger companies often also contractually oblige their suppliers to comply with the requirements of the Supply Chain Act.

Violations can result in fines and exclusion from public contracts. Companies must submit their reports by the end of 2025, with BAFA starting its review from 2026.

Risk analysis: Conduct a comprehensive risk analysis to identify and assess human rights and environmental risks along the entire supply chain.
Preventive measures: Develop and implement strategies to prevent potential breaches.
Remedial measures: Ensure that corrective action is taken immediately if violations are detected. You can document and follow up on these in the module.
Reporting and documentation: Document all measures and report transparently on your due diligence processes.
Complaints mechanism: Ensure that affected parties along the supply chain have access to a digital grievance mechanism.
Checking and monitoring suppliers: Companies must ensure that their direct suppliers comply with human rights and environmental standards and take the necessary measures to do so.
Employee training: Raising awareness and training employees with regard to human rights and environmental risks and internal processes for compliance with due diligence obligations.
Cooperation with authorities and partners: Companies should work with authorities and partners to strengthen compliance and improve transparency along the supply chain.
